Your product design is one of your most valuable assets. Here's how to protect it when working with an overseas injection molding partner.
Outsourcing injection molding to an overseas manufacturer is one of the most effective ways to reduce costs and access specialist capabilities. But for many product companies, the decision comes with a nagging concern: what happens to my design once I send it overseas? Will my CAD files be shared? Could a supplier copy my product? These are legitimate questions — and the good news is that the answers, when you choose the right partner, are reassuring.
This article lays out the legal framework that protects your intellectual property in Malaysia, the practical steps Ichiplas takes to safeguard your designs, and what you can do on your end to ensure your IP stays yours.
Malaysia's Legal Framework for IP
Malaysia has a well-established legal framework for intellectual property protection that aligns with international standards. For product companies considering manufacturing here, it's worth understanding what protections are already in place.
Patents Act 1983. If your product incorporates a patented invention, Malaysia's Patents Act provides legal protection for patent holders. Patents filed in Malaysia — or recognised through international treaties — give you the right to prevent others from manufacturing, selling, or using your patented invention without authorisation.
Trade Secrets. Not every competitive advantage comes from a patent. Process parameters, material formulations, tooling specifications, and design know-how often fall under the category of trade secrets. Malaysian law recognises the protection of confidential information through contract law and equitable principles. When backed by a well-drafted NDA, trade secrets are enforceable in Malaysian courts.
Industrial Designs Act 1996. This protects the visual appearance of a product — its shape, configuration, pattern, or ornamentation. If your product's aesthetic design is a key part of its market value, registering it under this act (or its equivalent in your home jurisdiction) provides additional protection.
Copyright Act 1987. Technical drawings, CAD files, and engineering documentation are protected by copyright as original works. This means that even without a registered patent or design, your engineering files cannot be legally copied or distributed without your permission.
Malaysia is also a signatory to the Paris Convention for the Protection of Industrial Property and is a member of the World Intellectual Property Organization (WIPO). This means that IP rights registered in other member countries are recognised and enforceable in Malaysia, and vice versa.

How Ichiplas Protects Your IP
Legal frameworks provide the foundation, but day-to-day protection comes from the practices your manufacturing partner puts in place. Here's how we handle it at Ichiplas.
Non-Disclosure Agreements
We execute a mutual NDA before any technical files are exchanged. This isn't a formality — it's a binding legal document that clearly defines what information is confidential, what obligations both parties have, the duration of those obligations, and the consequences of breach. We are happy to work with your company's standard NDA template or provide our own. The important thing is that it's in place before your first STEP file arrives.
File Security
Your CAD files, 2D drawings, and technical specifications are restricted to authorised engineering personnel on a need-to-know basis. Files are stored on secured, access-controlled systems — not on shared drives, personal laptops, or USB sticks. We do not use your files for any purpose other than the project you've engaged us for, and we do not share them with other clients or third parties.
Supplier Network Controls
For projects that involve external suppliers — for example, specialised tooling fabrication, surface treatment, or secondary processing — we extend confidentiality requirements down the supply chain. Our suppliers operate under their own confidentiality agreements with Ichiplas, and we control what technical information they receive. A surface treatment vendor, for example, sees only the specifications relevant to their process — not your full product design or assembly drawings.

Practical Steps You Can Take
IP protection is a shared responsibility. While your manufacturer should have robust practices in place, there are steps you can take on your end to strengthen your position.
File your IP before sharing. If your product includes a patentable invention or a distinctive industrial design, file for protection in your home jurisdiction before sending detailed technical files to any manufacturer. A provisional patent application is relatively inexpensive and establishes your priority date — giving you legal standing if a dispute ever arises.
Control file distribution. Only send the files your manufacturer actually needs. If you're at the quoting stage, a STEP file and 2D drawing may be sufficient — there's no need to share your native CAD files, full assembly models, or bill of materials at that point. As the project progresses, release additional information in stages as trust and contractual protections are established.
Visit your manufacturer. Nothing replaces seeing a facility in person. A factory visit lets you assess the professionalism of the operation, meet the people who will handle your files, and get a sense of whether the company takes confidentiality seriously. At Ichiplas, we welcome and encourage factory visits — our facility in Johor Bahru is easily accessible from Singapore.
When to Have the IP Conversation
The answer is simple: before you share anything. The best time to discuss IP protection with a potential manufacturing partner is at the very beginning of the relationship — before CAD files are exchanged, before quoting begins, and before any technical details are disclosed. A manufacturer that takes IP seriously will not only be willing to have this conversation early, they will expect it. If you're evaluating overseas manufacturing partners and want to understand how your designs will be protected, reach out to us. We're happy to walk you through our process and answer any questions — typically within 2 business days.
Frequently Asked Questions
Is my product design safe if I send it to a manufacturer in Malaysia?
Malaysia has robust IP laws — including the Patents Act 1983, Industrial Designs Act 1996, and Copyright Act 1987 — and is a signatory to the Paris Convention and WIPO treaties. When you work with a reputable manufacturer like Ichiplas that uses enforceable NDAs, file access controls, and supplier-level confidentiality agreements, your designs are well protected. The key is choosing a partner that takes IP protection seriously from day one.
What should be included in an NDA with an overseas manufacturer?
An effective NDA should clearly define what constitutes confidential information (CAD files, specifications, tooling designs, process parameters), specify the obligations of both parties, set a meaningful duration (typically 3–5 years, or longer for trade secrets), include remedies for breach, and specify governing law and jurisdiction. It should be signed before any technical files are shared.
How does Ichiplas protect my CAD files and technical data?
Ichiplas restricts CAD file access to authorised engineering personnel on a need-to-know basis. Files are stored on secured, access-controlled systems — not on shared drives or personal devices. We do not share your technical data with other clients or third parties. Where external suppliers are involved (e.g. for specialised tooling), they operate under their own confidentiality agreements with Ichiplas.
Should I file a patent before sending my design to a manufacturer?
If your design includes a novel mechanism, process, or functional innovation, filing a patent (or at minimum a provisional patent application) in your home jurisdiction before sharing detailed files is strongly recommended. For designs that rely on trade secrets rather than patentable features, a well-drafted NDA combined with controlled file distribution provides strong protection.
Can I visit Ichiplas to verify how my IP is handled?
Absolutely. We welcome factory visits and encourage clients to see our facility, meet the engineering team, and understand our processes first-hand. Our factory in Johor Bahru is easily accessible from Singapore. Contact us to arrange a visit — we typically respond within 2 business days.
